Once the child is born the parents have to go through the process of adopting the child regardless of whether or not their name is on the birth certificate. However, the ART law has gotten rid of that necessity. So long as intended-parents have entered into a gestational agreement at least 14 days prior to embryo transfer, the parental rights of the intended-parents are protected, and the surrogate has no parental rights to the child once it has been born.
