Why is this important?
In most cases, intended parents don’t have rights to their child(ren) who are born via surrogacy until they are born. Once the child is born the parents have to go through the process of adopting the child regardless of whether or not their name is on the birth certificate. This is because family law favors the mother, or in this case, the gestational carrier.
However, the ART law has gotten rid of that necessity. So long as intended-parents have entered into a gestational agreement at least 14 days prior to embryo transfer, the parental rights of the intended-parents are protected, and the surrogate has no parental rights to the child once it has been born.
