Gestational Surrogacy in Texas: What Intended-Parents Should Know

If you have chosen surrogacy as a means to grow or start your family — congratulations! Surrogacy is a deeply rewarding journey that grants the gift of a precious bundle of joy at its end. Although the decision to pursue surrogacy was a big one, you’ve still got a few more important decisions to make including what surrogacy agency you should work with and where? We want to help make your decision easier. That’s why we’ve put together this short guide with everything intended-parents need to know about gestational surrogacy in Texas.

Why Should Intended-Parents Choose Surrogacy in Texas?

They say that everything is bigger in Texas and maybe it’s true! Texas features some of the most comprehensive and clear surrogacy laws in the country. Texas is considered a surrogacy-friendly state and has passed the Assisted Reproduction Technology (ART) law which protects the parental rights of couples who have entered surrogacy agreements.

Why is this important?

In most cases, intended parents don’t have rights to their child(ren) who are born via surrogacy until they are born. Once the child is born the parents have to go through the process of adopting the child regardless of whether or not their name is on the birth certificate. This is because family law favors the mother, or in this case, the gestational carrier.

However, the ART law has gotten rid of that necessity. So long as intended-parents have entered into a gestational agreement at least 14 days prior to embryo transfer, the parental rights of the intended-parents are protected, and the surrogate has no parental rights to the child once it has been born.

Another Advantage Intended Parents have in choosing Texas for their surrogacy is cost. The Texas Advantage allows Texas Agencies, like Simple Surrogacy, to charge significantly less than coastal agencies while also offering a higher level of client care. Texas does not have an income tax, meaning that we can pass along nearly 10% in savings to our clients.

Being centrally located within the US also allows easy communication with Parents and clinics located country wide due to our central time zone.

Our agency knows how expensive surrogacy can be, but we strive to make it a more accessible process by passing along savings to our clients.
